FAMILY LAW
Laws Scott, PLLC are
experienced in helping you deal with any family
law situation and can help you get the best
outcome possible during difficult times.
A family law issue can be a
very trying time in anyone’s life. Whether you
are going through a divorce, paternity action,
child custody issue, child support issue,
domestic violence proceeding, relocation case or
a post judgment proceeding.
As compared to other legal
issues, family law cases are more sensitive and
unique to the parties because you are dealing
not only with your life, but the future of your
children's lives as well. During a divorce
proceeding, the Court will address the custody
and support of children, alimony, separation of
property, division of assets and debts as well
as attorneys fees. You need experienced legal
counsel during this time to guide you through
this maze of legal issues.
Unlike many civil cases which
conclude upon the rendering of a Final Judgment,
Final Judgments in family law cases often
require the parties to return to Court years
later to enforce court orders against
noncompliant parties or to modify child support,
child custody, relocation restrictions and/or
alimony when there has been a change in
circumstances of one or both of the parties or
the children.
If you or someone you know
needs legal help and assistance concerning a
divorce, contact us now. Although a divorce,
paternity action or modification proceeding can
be an emotional process, the majority of cases
do not result in a trial. The Court will require
the parties to attend mediate prior to trial in
an effort to resolve the issues amongst
themselves. If the issues are resolved a trial
is not required. With the help of an
experienced divorce lawyer the two divorcing
parties may be able to negotiate and settle
upon:
-
Division of Property
-
Division of Debts
-
Child Custody
-
Spousal Support
-
Child Support
In order to file for divorce
in Florida there is requirement of residency for
at least one of the parties to reside in Florida
for a period of 6 months preceding the filing
date. The venue, or county, where the case
should be filed is in the county where the
parties last lived as husband and wife.
Family law is the term
applied to the laws and rules developed
regarding family relationships. Family law rules
define not only the relationships between
members of a family but also between a family
and society as a whole. More than any other area
of the law, family law reflects the values
society shares regarding how people who are
related should treat each other. When you are
faced with an important life decision regarding
a key family relationship, the advice and
assistance of a family law attorney often proves
crucial to your understanding of the issues
involved and your satisfaction with the ultimate
outcome of your family law matter.
Typically, family law
attorneys assist people in making and breaking
family relationships. Specific areas of
representation include marriage and relationship
planning, divorce, paternity, child custody, and
child support and adoption.
